Bài viết phân tích thực trạng công tác quản lý, giám sát việc thực hiện quyền và nghĩa vụ của hộ gia đình, cá nhân sử dụng đất trên địa bàn thành phố Đà Lạt, tỉnh Lâm Đồng trong giai đoạn 2020-2024. Trên cơ sở hệ thống hóa lý luận, cơ sở pháp lý và khảo sát thực tiễn địa phương, nghiên cứu đã chỉ ra một số bất cập trong việc quản lý, giám sát cấp Giấy chứng nhận quyền sử dụng đất (GCNQSD đất), quyền sở hữu nhà ở và tài sản khác gắn liền với đất; việc khiếu nại, tố cáo, khởi kiện về những hành vi vi phạm pháp luật về đất đai; việc sử dụng đất đúng mục đích, đúng ranh giới; việc kê khai đăng ký đất đai; việc thế chấp, góp vốn bằng quyền sử dụng đất; việc thực hiện nghĩa vụ tài chính; quy định về bảo vệ môi trường. Trên cơ sở đó, bài viết đề xuất một số giải pháp hoàn thiện công tác quản lý, giám sát quyền và nghĩa vụ của hộ gia đình, cá nhân sử dụng đất trên địa bàn thành phố Đà Lạt.

The article analyzes the current situation of the management and supervision of the implementation of rights and obligations of households and individuals using land in Da Lat City, Lam Dong Province, during the period 2020–2024. Based on a systematization of theoretical foundations, legal frameworks, and field surveys, the study identifies several shortcomings in the management and supervision of the issuance of Land Use Rights Certificates (LURCs), ownership of residential houses and other properties attached to land; in the handling of complaints, denunciations, and lawsuits related to violations of land legislation; in ensuring the proper use of land in accordance with designated purposes and boundaries; in land registration and declaration; in mortgage and capital contribution using land use rights; in the fulfillment of financial obligations; and in compliance with environmental protection regulations. Accordingly, the article proposes several solutions to improve the management and supervision of land use rights and obligations of households and individuals in Da Lat City.
